Terms and Conditions for Terra Invest Solutions (TIS)

Introduction

Welcome to Terra Invest Solutions (TIS), a premier property management company based in *Green Coast, Palasë, Albania*. By using our services, you agree to abide by the following Terms and Conditions. Please read them carefully as they outline the responsibilities, rights, and obligations between TIS and our clients, guests, and partners.

Definitions

  • “TIS”: Refers to Terra Invest Solutions, the service provider.
  • “Client”: The property owner or individual/entity entering into an agreement with TIS for property management services.
  • “Guest”: The person(s) renting or staying in a managed property.
  • “Property”: The real estate unit managed by TIS on behalf of the client.

Scope of Services

  • Tenant acquisition and screening
  • Lease management
  • Property maintenance and repairs
  • Financial management (e.g., rent collection, expense tracking)
  • Marketing and listing of holiday rentals
  • Customer service and support for guests

The specific scope of services for each client will be detailed in a separate Service Agreement.

For Guests:

  • Guests must use the property solely for residential or holiday purposes and not for any unlawful activity.
  • The maximum number of occupants allowed in the property must not exceed the limit specified in the booking agreement.
  • Pets, smoking, and parties may only be permitted as outlined in the property-specific rules.

For Clients:

  • Clients are responsible for providing accurate property details, ensuring compliance with local regulations, and maintaining property insurance.
  • TIS is not liable for any legal issues arising from non-compliance with local laws.

Booking and Payment Terms (For Guests)

  • Guests are required to provide accurate information during the booking process.
  • A reservation is confirmed only upon receipt of the deposit or full payment as per the booking agreement.
  • Full payment must be made before check-in unless otherwise specified.

Fees and Payments (For Clients)

  • TIS charges a management fee for services rendered, detailed in the signed Service Agreement.
  • Additional fees for marketing, repairs, or specialized services will be communicated in advance.
  • Payments to clients (e.g., rental income) will be disbursed based on the agreed schedule, after deducting TIS’s fees and any applicable costs.

Cancellation Policy

  • TIS charges a management fee for services rendered, detailed in the signed Service Agreement.
  • Additional fees for marketing, repairs, or specialized services will be communicated in advance.
  • Payments to clients (e.g., rental income) will be disbursed based on the agreed schedule, after deducting TIS’s fees and any applicable costs.

For Guests

  • Cancellations must be made in writing. Refunds will be issued based on the cancellation terms outlined in the booking agreement.
  • No-shows or early departures will not be eligible for a refund.

For Clients

  • Termination of the management contract requires advance written notice, as stipulated in the Service Agreement.

Maintenance and Repairs

  • TIS will oversee regular maintenance and address repair issues promptly.
  • Clients are responsible for covering costs associated with significant repairs, unless otherwise agreed.
  • Guests must report damages or maintenance issues immediately. Any damages caused by guests beyond normal wear and tear may result in additional charges.

Liability and Insurance

For Guests

  • TIS is not liable for injuries, losses, or damages incurred during the guest’s stay, except in cases of gross negligence by TIS.
  • Guests are encouraged to have personal travel insurance.

For Clients

  • Clients must maintain adequate insurance coverage for their property, including liability and property damage.
  • TIS is not responsible for theft, loss, or damages caused by third parties, natural disasters, or tenant actions beyond reasonable control.

Privacy and Data Protection

  • TIS collects and processes personal information in compliance with applicable data protection laws.
  • Information provided by clients and guests will not be shared with third parties without consent, except as necessary to fulfill contractual obligations.

Termination of Services

  • Either party may terminate the management agreement by providing written notice as specified in the Service Agreement.
  • TIS reserves the right to terminate agreements with clients or guests in cases of non-compliance, breach of terms, or unethical conduct.

Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by the laws of Albania.
  • Any disputes arising between TIS and clients or guests will first be resolved through negotiation. If no resolution is reached, disputes will be subject to arbitration or legal proceedings in the jurisdiction of Albania.

Amendments to Terms and Conditions

TIS reserves the right to update or modify these Terms and Conditions at any time. Clients and guests will be notified of significant changes in advance. Continued use of TIS services constitutes acceptance of the updated terms.
